Welcome to Hillston Clouver.

These Terms of Service (“Terms”) govern your access to and use of HillstonClouver.store (the “Website”), including any purchases made through the Website.

Throughout these Terms, “Hillston Clouver”, “we”, “us” and “our” refer to Hillston Clouver. “You” and “your” refer to any person accessing the Website or purchasing products from us.

Nothing in this section limits your rights where a product does not correspond with its description or otherwise fails to comply with a consumer guarantee under the Australian Consumer Law.

Products may be available exclusively online and may be subject to availability.

3. Product Availability

All products are subject to availability.

We may limit quantities available for purchase where reasonably necessary, including because of stock availability, fraud prevention or supply limitations.

Adding an item to your shopping cart does not reserve that product.

If an item becomes unavailable after you place an order, we will contact you and provide an appropriate solution, which may include cancellation and a refund of the affected amount.

4. Pricing

Prices displayed on the Website are presented in the currency indicated at checkout.

For customers purchasing through our Australian storefront, prices will ordinarily be displayed in Australian dollars (AUD) unless clearly stated otherwise.

Any applicable taxes, shipping charges or other charges will be disclosed as required before you complete your purchase.

We may change product prices from time to time. Price changes will not retrospectively alter the agreed price of an order that has already been accepted, except where permitted or required by law.

If we cancel an order after payment has been received and no goods are supplied, the relevant amount will be refunded to the original payment method, unless another method is agreed or required by law.

We will not cancel orders for discriminatory, arbitrary or unlawful reasons.

Available payment methods will be displayed during checkout.

Your use of a third-party payment service may also be subject to that provider’s applicable terms and privacy practices.

We do not guarantee that every payment method will be available for every transaction.

Delivery estimates are estimates only unless we expressly agree otherwise.

If you notice an error in your shipping address, please contact us as soon as possible at contact@HillstonClouver.store.

We cannot guarantee that an address can be changed after an order has entered processing or been dispatched.

Any rights or responsibilities concerning delivery will remain subject to applicable Australian law.

12. Returns, Refunds and Exchanges

Returns, refunds and exchanges are handled in accordance with our Return & Refund Policy and the Australian Consumer Law.

Our voluntary change-of-mind return policy is separate from your statutory consumer rights.

Any time limits or conditions applying to voluntary change-of-mind returns do not restrict your rights where products fail to satisfy an applicable consumer guarantee.

13. Australian Consumer Law

If you are a consumer for the purposes of the Australian Consumer Law, our goods come with guarantees that cannot be excluded under the ACL.

Depending on the circumstances and the nature of a failure, you may be entitled to remedies including repair, replacement, refund, compensation or other remedies available under applicable law.

14. Major and Minor Failures

Where goods fail to satisfy a consumer guarantee, the remedy available will depend on the circumstances and whether the failure is major or minor under the Australian Consumer Law.

For a major failure with goods, consumers may have the right to reject the goods and choose between a refund or replacement, subject to the ACL.

For a failure that is not major, we may be entitled to provide an appropriate remedy within a reasonable time.

These Terms do not alter the remedies provided by law.

15. Promotions and Discount Codes

From time to time, we may offer discounts, promotional codes, bundles or other promotional offers.

Promotions may be subject to specific terms disclosed with the offer.

Unless otherwise stated:

  • promotional codes cannot be redeemed for cash;

  • only eligible products qualify;

  • promotions are subject to stated availability; and

  • a promotional code may be limited to one use per customer or order where disclosed.

Promotional conditions will not exclude rights that cannot lawfully be excluded under the Australian Consumer Law.

16. Gift Cards

Where gift cards are offered, additional conditions may apply.

Any gift card expiry dates, fees and conditions will comply with applicable Australian law.

Gift cards cannot generally be exchanged for cash except where required by law.
